These Terms of Use govern your use of wpbtechhappyhour.com (the “Site”) and your attendance at events organized by West Palm Beach Tech Happy Hour LLC (“WPB Tech Happy Hour,” “we,” “us”). By using the Site, registering for, or attending an event, you agree to these Terms. If you do not agree, please do not use the Site or attend our events.

1. Our events

WPB Tech Happy Hour hosts a monthly meetup for the West Palm Beach tech community, usually on the third Tuesday of each month at Top of the Rox, 309 Clematis Street, West Palm Beach, plus special editions such as pitch nights and Palm Beach Tech Week events. Dates, themes, speakers, sponsors and venues may change or be cancelled at any time.

2. Registration and tickets

• Registration and ticket sales are handled by third-party platforms (such as Luma or Eventbrite). Their terms and refund policies also apply to your purchase.
• Ticket prices, discounts and free admission for approved founders are set per event and shown on the event’s registration page.
• Unless the event page says otherwise, tickets are non-transferable and non-refundable, except where we cancel an event, in which case we will refund the ticket price.
• We may decline or cancel a registration, or ask a guest to leave, at our discretion, including for violations of our Code of Conduct.

3. Alcohol and venue rules

Our events take place at licensed venues that serve alcohol. You must be of legal drinking age (21 in Florida) and show valid ID to be served alcohol. Non-alcoholic drinks are available. You agree to follow the venue’s rules and staff instructions, and to drink responsibly and arrange safe transportation.

4. Photography and video

Our events are photographed and recorded. By attending, you consent to being photographed, filmed and recorded, and you grant us and our sponsors a non-exclusive, royalty-free, worldwide license to use those images and recordings, including your likeness, to promote WPB Tech Happy Hour on our website, social media, email, and printed and venue displays, without compensation. If you would prefer not to be featured, tell a host or our photographer at the event, or email us afterward and we will make reasonable efforts to remove a specific image from our channels.

5. Pitch nights and submissions

If you apply to pitch, speak, sponsor, volunteer or otherwise submit material to us, you confirm that you have the right to share it and you allow us to review it and, if you are selected, to display it at the event and in event promotion. Do not submit confidential information. We do not sign non-disclosure agreements for pitch submissions, and pitch decks may be seen by attendees, judges and investors. Selection decisions are final.

6. Sponsors and third parties

Sponsors, partners, speakers and attendees are independent of WPB Tech Happy Hour. We do not endorse, and are not responsible for, their products, services, statements, offers or investments. Any business you do with them is between you and them. Nothing at our events or on the Site is investment, legal or financial advice.

7. Use of the Site

You may use the Site for personal, non-commercial purposes. You may not misuse the Site, attempt to interfere with its operation, scrape it in bulk, or use our forms to send spam. The WPB Tech Happy Hour name, logo, event names (including Sink or Swim™ and Your Theme™), photographs, and Site content are our property or used with permission; you may not use them without our written permission, except to share links and accurately describe our events.

8. Assumption of risk

Attending in-person events involves ordinary risks, including those related to crowds, alcohol, pool decks and rooftop venues. You attend voluntarily and are responsible for your own conduct, safety and belongings.

9. Disclaimers and limitation of liability

The Site and our events are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, and West Palm Beach Tech Happy Hour LLC, its members, organizers, volunteers and sponsors will not be liable for any indirect, incidental, special or consequential damages, or for loss of property, arising from your use of the Site or attendance at an event. Our total liability for any claim will not exceed the amount you paid us for the event giving rise to the claim, or $100 if you paid nothing.

10. Indemnity

You agree to indemnify and hold harmless West Palm Beach Tech Happy Hour LLC and its organizers and volunteers from claims arising from your conduct at our events, your submissions, or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Palm Beach County, Florida.

12. Changes

We may update these Terms from time to time. The “Last updated” date shows when they last changed. Continuing to use the Site or attend events after a change means you accept the updated Terms.
